Photos with an MLS license may not be used for Rental Properties. A Commercial License must be purchased.
LIMITS Usage rights are granted to the primary listing agent for the duration of their active listing contract. Photos/Media may be used by the primary listing agent to market and sell the subject property in a customary manner. Only web-sized photos may be uploaded online and to social media. Photos/Media may be used in traditional print materials such as brochures & postcards.
What does this mean? These photos are owned and copyrighted by Pierce Pixels. Your license to these photos is temporary, and valid until your active listing contract ends. You may purchase a new license to use these photos for future marketing.
DISTRIBUTION Photos/Media may be used for commercial use such as marketing/advertising of yourself and the property listed only during the term of the active listing contract. They may NOT be used to market/advertise your brokerage. Photos/Media may never be distributed or sold to any third-party for use in any way. Usage rights must be purchased from Pierce Pixels for every third-party use.
What does this mean? It means you may NOT send any of Pierce Pixels photos to another Agent for use in their marketing or listing.
MARKETING Pierce Pixels may use photos/media for marketing purposes at any time unless a prior written agreement has been made.
COMPLIANCE WITH ADVERTISING STANDARDS Pierce Pixels provides professional image editing services at the specific direction of the Client. The Client acknowledges that various jurisdictions, Multiple Listing Services (MLS), and regulatory bodies have specific and evolving rules regarding the disclosure of "digitally altered" images. It is the sole responsibility of the Client to determine if the provided images require disclosure under local laws, professional codes of ethics, or MLS guidelines. By accepting and using these images, the Client assumes all liability for the proper disclosure and representation of the property in all marketing materials and agrees to hold Pierce Pixels harmless from any fines, legal actions, or disciplinary measures resulting from the use or publication of these images.
